Terms and Conditions

2.1 Acceptance

By creating an account or otherwise using the Platform, you agree to these Terms and Conditions ("Terms"), the Privacy Policy, the Cookie Policy, and the disclaimers referenced throughout (Documents 3–6), all of which are incorporated by reference. If you do not agree, do not use the Platform. Clicking "I agree," checking a consent box, or continuing to use the Platform after being shown these Terms constitutes electronic acceptance with the same legal effect as a handwritten signature, to the extent permitted by applicable law (including the EU eIDAS Regulation and the Philippine Electronic Commerce Act).

2.2 Eligibility

You must be at least 16 years old (or the minimum age of consent for information society services in your EU member state) or the equivalent minimum age under Philippine law to create an account. If you are between that minimum age and the age of majority in your jurisdiction, you confirm you have permission from a parent or guardian. You must also have the legal capacity to enter binding agreements and must not be barred from using the Platform under applicable law.

2.3 User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at team@lactogo.eu of any unauthorized use. Provide accurate registration information and keep it up to date. LactoGo may suspend or terminate accounts that contain false information.

2.4 Acceptable Use

You agree not to: use the Platform for any unlawful purpose; upload content that infringes third-party rights; misuse LactoLens, Luna, or Dairy Diary to generate or spread false health or medical claims; attempt to reverse-engineer, scrape, or interfere with the Platform's operation or security; upload malware or attempt unauthorized access to other accounts or systems; impersonate any person or entity; or use the Platform to harass, defame, or harm others. Additional community-specific rules are set out in Document 9: Community Guidelines, which forms part of these Terms.

2.5 Community Rules

LactoGo's community lives primarily on Instagram (@wearelactogo) and #LactoGoMoments. Document 9 applies to your interactions there and through any in-Platform feedback channel. LactoGo may moderate, remove content, or restrict access for violations, at its reasonable discretion, with notice where practicable.

2.6 User Content

You retain ownership of content you submit (including feedback, images uploaded for scanning, Dairy Diary entries, and profile information) ("User Content"). By submitting User Content, you grant LactoGo a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, and display that content solely to operate, provide, and improve the Platform. You represent that you have the necessary rights to submit your User Content and that it does not infringe third-party rights or applicable law.

2.7 Intellectual Property and Licensing

The Platform, including the LactoGo name and logo, the Luna assistant, LactoLens, the 28-Day Challenge, Dairy Diary, software, and design, is owned by LactoGo or its licensors and protected by intellectual property laws. Subject to your compliance with these Terms, LactoGo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Platform, or reverse-engineer or attempt to extract source code, except where permitted by mandatory law.

2.8 Future Subscriptions and Paid Features

LactoGo may in the future introduce paid or subscription features. When introduced, such features will be governed by additional pricing, billing, and cancellation terms presented at the point of purchase, which will supplement (not replace) these Terms. Consumer rights regarding distance contracts, withdrawal periods, and refunds under EU Directive 2011/83/EU and applicable Philippine consumer protection law will be honored for such offerings.

2.9 Third-Party Services, API Integrations, and Data Sources

The Platform relies on or integrates with third-party services, including OpenFoodFacts and other barcode/nutrition databases, Cloudflare (security and content delivery), IONOS (hosting, in Spain), US-based cloud storage and infrastructure providers, and — where you choose to connect them — future services such as Apple Health, Google Health Connect, MyFitnessPal, or wearable device platforms. LactoGo does not control these third parties and is not responsible for their availability, accuracy, or practices; your use of any third-party integration is also subject to that provider's own terms and privacy policy. See Document 7: Limitation of Liability for the allocation of risk relating to third-party and API failures.

2.10 Suspension and Termination

LactoGo may suspend or terminate your account, with or without notice, if you violate these Terms, the Community Guidelines, or applicable law, or where necessary to protect the Platform, other users, or LactoGo. You may close your account at any time by contacting team@lactogo.eu or via in-app settings. Sections that by their nature should survive termination (including Documents 3–8 and Sections 2.6, 2.7, 2.12–2.19) will survive.

2.11 Updates to the Platform and Terms

LactoGo may update the Platform's features and these Terms from time to time, including to reflect new features described in Document 12. We will provide notice of material changes via the Platform or email, with a reasonable opportunity to review before they take effect. Continued use after the effective date constitutes acceptance.

2.12 Governing Law and Jurisdiction

These Terms are governed by the laws of Estonia, without regard to conflict-of-laws principles, without prejudice to any mandatory consumer-protection rights you have under the laws of your country of residence if you are a consumer in the EEA or the Philippines, which will continue to apply where mandatorily applicable.

2.13 Dispute Resolution

Before initiating formal proceedings, the parties agree to attempt in good faith to resolve any dispute through direct negotiation by contacting team@lactogo.eu. EEA consumers may also use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr). Unresolved disputes shall be subject to the exclusive jurisdiction of the competent courts of Estonia, except where mandatory consumer law grants you the right to bring proceedings in your own country of residence, or where local law in the Philippines grants you access to Philippine courts or the appropriate government agency for consumer or privacy complaints.

2.14 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and the disclaimers in Documents 3–6, constitute the entire agreement between you and LactoGo regarding the Platform, superseding any prior agreements on the same subject matter.

2.15 Electronic Acceptance

You agree that electronic acceptance (clicking to accept, checking a box, or continued use following notice) is valid and enforceable, and that LactoGo may provide notices and disclosures electronically.

2.16 Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

2.17 Force Majeure

LactoGo is not liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, internet or cloud-provider outages (including Cloudflare or our hosting or cloud storage providers), acts of government, labor disputes, or failures of third-party data sources or APIs.

2.18 Assignment

You may not assign or transfer these Terms without LactoGo's prior written consent. LactoGo may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets, provided the assignee agrees to honor these Terms.

2.19 No Waiver

LactoGo's failure to enforce any provision of these Terms is not a waiver of its right to do so later. Any waiver must be in writing to be effective.

Document 3: Medical Disclaimer

LactoGo is a personal food-awareness and behavioral-intelligence platform, not a medical device, healthcare provider, diagnostic tool, treatment, pharmacy, or supplement seller. Nothing on the Platform constitutes medical advice, and information is provided for essential awareness only.

Nothing produced by the Platform — including Luna's responses, LactoLens scan results, Dairy Diary trends, 28-Day Challenge insights, Learn articles, or any future feature — diagnoses lactose intolerance, milk allergy, dairy allergy, or any digestive or other disease or condition. The Platform does not assess your individual health status and cannot tell you whether a food is safe for you to eat.

The 28-Day Challenge is not a clinical trial and is not a promise that any habit, tolerance, or outcome will be permanently formed or resolved in 28 days. It is a structured, self-directed period for observing your own food patterns — nothing more. Streaks, badges, and pattern insights reflect your own logged activity, not a clinical assessment.

Nothing on the Platform replaces the advice of a doctor, registered dietitian, allergist, or pharmacist. Always seek the advice of a qualified healthcare professional regarding any question you have about a medical condition, symptom, allergy, or dietary restriction, and before making any change to your diet, medication, or treatment based on anything you read or receive on the Platform. Never disregard professional medical advice or delay seeking it because of something you saw on LactoGo.

If you believe you are experiencing a medical emergency, including a severe allergic reaction, call your local emergency number immediately (e.g., 112 in the EU, 911 in relevant jurisdictions, or your local equivalent) or go to the nearest emergency room. Do not rely on the Platform in an emergency.

This disclaimer applies to all current features and to all future features described in Document 12, including any future research participation or health-app integrations, which remain non-diagnostic unless expressly and separately stated otherwise in writing by LactoGo.

Document 4: Food Scanner Disclaimer

LactoLens (photo scanning and barcode scanning) is a personal awareness aid, not a guarantee of accuracy. Please read this before relying on any scan result.

Barcode databases (including OpenFoodFacts) may be incomplete or outdated. Not every product is listed, and listings may not reflect the specific batch, region, or size variant you are holding.
Manufacturers change recipes and formulations without always updating public databases or barcodes, sometimes with no advance warning.
Food labels themselves change over time and can vary by country, region, or retailer, even for what looks like the same product.
OCR (optical character recognition) may misread text, especially on damaged, glare-affected, foreign-language, or unusually formatted labels.
Image recognition may misidentify food items, ingredients, or packaging, particularly with poor lighting, unusual angles, or unfamiliar products.
AI-generated interpretations, including confidence scores, may misunderstand ingredient lists, including missing, misreading, or mischaracterizing an ingredient, allergen statement, or "may contain" warning. A high confidence score is not a guarantee of accuracy.

You must always independently verify the physical packaging, ingredient list, and allergen statements before consuming any product, rather than relying solely on a LactoLens result. LactoGo cannot and does not guarantee the accuracy, completeness, or currency of any scan result, and cannot and does not certify that any food product is safe, allergen-free, or suitable for any particular person or diet. Scan results are provided "as is" for personal awareness purposes only, and — as described in the Privacy Policy — scan images themselves are auto-deleted from our systems within 24 hours. See also Document 5: Allergy Disclaimer and Document 6: AI Disclaimer.

Document 5: Allergy Disclaimer

This is an extremely important notice. Please read it in full, especially if you or someone you are shopping for has a milk allergy, dairy allergy, or any other food allergy.

LactoGo's LactoLens and Luna do not detect, diagnose, or certify allergies of any kind, and no result or confidence score from the Platform should ever be treated as confirmation that a food is safe for someone with an allergy.

Food allergies, including milk and dairy allergy, can cause severe and life-threatening reactions, including anaphylaxis. The following risks exist independently of anything LactoGo can control, and mean that no digital tool — including LactoGo — can ever guarantee allergen safety:

Cross-contamination can occur during manufacturing, packaging, transport, or preparation, even where an ingredient list does not mention an allergen.
Manufacturers change formulations, suppliers, and facilities at any time, sometimes without changing the barcode or visible packaging design.
Hidden or unexpected ingredients (including milk derivatives under non-obvious names) may appear in products not traditionally associated with dairy.
Databases, OCR, and image recognition are all subject to the errors described in Document 4, any one of which could cause an allergen to be missed or misreported.

Because of these risks, users with any food allergy — or shopping for someone with a food allergy — must always independently read the physical product packaging and ingredient list themselves, every time, regardless of any prior scan result, and must not rely on LactoGo as a substitute for that check. LactoGo does not certify any food as "allergen-free," "dairy-free," or "safe," even if a scan result or confidence score appears favorable, and disclaims all responsibility for allergic reactions, including anaphylaxis, arising from reliance on the Platform.

If you or someone near you is experiencing a suspected allergic reaction or anaphylaxis (symptoms may include difficulty breathing, swelling of the face/throat, hives, dizziness, or loss of consciousness), call emergency services immediately and use an epinephrine auto-injector if prescribed and available. Do not consult the Platform in an emergency — seek immediate medical attention.

Document 6: AI Disclaimer (Luna and Automated Features)

Luna is an AI-powered companion. Please understand its limitations before relying on its output.

Luna's responses are generated automatically using artificial intelligence models and pattern-based predictions, not human review of your specific situation. As with all AI systems, Luna's responses may be incomplete, may omit relevant context, and may contain inaccuracies, including confidently stated but incorrect information (sometimes called "hallucination"). Luna does not know your full medical history, cannot examine you or your food, and cannot verify facts against real-world packaging in the way described in Documents 4 and 5. The same limitations apply to LactoLens confidence scores and to any personalized pattern insight the 28-Day Challenge or Dairy Diary surfaces to you — these reflect automated processing of what you logged, not a clinical assessment.

Luna's responses should never replace professional advice from a doctor, dietitian, allergist, pharmacist, or other qualified professional, and should not be treated as a definitive or final answer on any health, dietary, allergy, or safety question. Users should independently verify any important information Luna provides — including ingredient claims, nutritional information, and any suggestion about lactose or dairy content — before acting on it, particularly where health or allergy safety is involved.

This disclaimer applies to Luna, LactoLens, Dairy Diary, the 28-Day Challenge, and any other automated or AI-assisted feature on the Platform now or in the future, including any future AI agents, personalized recommendation features, or research-related AI tools described in Document 12.

Document 7: Limitation of Liability

Please read this section carefully. It limits LactoGo's liability to you.

7.1 Platform Provided "As Is"; No Warranty

The Platform, including LactoLens, Luna, Dairy Diary, the 28-Day Challenge, and any Learn content, is provided "as is" and "as available," for personal awareness purposes only, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by applicable law. Nothing in this Section limits any statutory rights that cannot lawfully be excluded, including certain consumer protections under EU or Philippine law.

7.2 Protected Parties

This limitation of liability is for the benefit of LactoGo, its founders, officers, directors, employees, contractors, developers, volunteers, researchers, community partners, affiliates, licensors, and service providers (including our hosting, security, and cloud storage providers) (together, the "Protected Parties"), each of whom may rely on and enforce this Section directly.

7.3 Exclusion of Certain Damages

To the maximum extent permitted by law, in no event will the Protected Parties be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill, or data, arising out of or relating to your use of, or inability to use, the Platform, even if advised of the possibility of such damages.

7.4 Specific Areas of Excluded Liability

Without limiting the foregoing, the Protected Parties are not liable, to the maximum extent permitted by law, for any loss or harm arising from or relating to: (a) personal, health, or food decisions you make based on the Platform, including decisions made during or influenced by the 28-Day Challenge; (b) the accuracy of LactoLens results and confidence scores, including barcode database errors or OCR errors as described in Document 4; (c) AI outputs, including Luna's responses and Dairy Diary/Challenge pattern insights, as described in Document 6; (d) content shared in the LactoGo community, including on Instagram or under #LactoGoMoments; (e) third-party integrations and API failures, including OpenFoodFacts, future health-app integrations, or wearables; (f) outages of our hosting, security, or cloud storage providers, including Cloudflare, IONOS, or our US-based cloud infrastructure, beyond LactoGo's reasonable control; and (g) software bugs, errors, or interruptions in the Platform.

7.5 Aggregate Cap

To the maximum extent permitted by applicable law, the total aggregate liability of the Protected Parties arising out of or relating to the Platform, whether in contract, tort, or otherwise, shall not exceed the greater of (i) the total amount you paid LactoGo for the Platform in the twelve (12) months preceding the claim, or (ii) EUR 100, except where such a cap is not permitted by mandatory consumer law applicable to you, or in cases of death or personal injury caused by proven negligence, fraud, or willful misconduct, for which liability is not excluded or limited to the extent prohibited by law.

7.6 No Limitation of Mandatory Rights

Nothing in this Section 7 excludes or limits liability that cannot lawfully be excluded or limited under EU law, Estonian law, or the law of the Philippines, including liability for death or personal injury caused by negligence, fraud, or willful misconduct, or statutory consumer guarantees that cannot be waived.

Document 8: Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless LactoGo, its founders, directors, officers, employees, contractors, developers, volunteers, community partners, research collaborators, affiliates, and service providers (together, the "Indemnified Parties") from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to:

your misuse of the Platform or violation of these Terms or the Community Guidelines;
your violation of any applicable law or third-party right, including data protection, consumer protection, or intellectual property law;
User Content you submit, post, or transmit through the Platform or the LactoGo community (including Instagram);
health or medical decisions you make in reliance on the Platform;
your participation in the 28-Day Challenge, and any outcomes, patterns, or conclusions you draw from your streaks, badges, or Dairy Diary entries;
your reliance on Luna or any AI output, or on LactoLens results or confidence scores, in a manner inconsistent with Documents 3–6;
any food allergy incident, including reactions arising from reliance on scan results rather than independent verification of packaging as required by Documents 4 and 5;
your use of third-party integrations connected through the Platform (e.g., future health-app or wearable integrations);
copyright or other intellectual property infringement arising from content you submit; and
misconduct in the community or fraudulent activity on your account.

LactoGo reserves the right, at your expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with LactoGo's defense. This obligation survives termination of your account and these Terms.

Document 9: Community Guidelines

These Guidelines apply wherever the LactoGo community gathers — including Instagram (@wearelactogo), the #LactoGoMoments hashtag, and any in-Platform feedback channel — and are part of the Terms and Conditions (Section 2.5). Violations may result in content removal, warnings, suspension, or termination of your account or community access, at LactoGo's reasonable discretion.

Prohibited conduct:

Medical misinformation — posting false, misleading, or unverified claims presented as medical fact, including claims that a product cures, treats, diagnoses, or prevents any disease.
Dangerous advice — recommending actions that could cause physical harm, including unsafe dietary practices, ignoring allergy risks, or discouraging others from seeking professional medical care.
Harassment or bullying — targeting other users with abusive, threatening, or demeaning behavior.
Spam — repetitive, unsolicited, or irrelevant posting, including unauthorized advertising.
Hate speech — content that attacks or demeans people based on race, ethnicity, nationality, religion, disability, gender, sexual orientation, age, or similar characteristics.
Illegal activity — promoting or facilitating unlawful conduct of any kind.
False health claims — misrepresenting your own or a product's health effects, credentials, or qualifications.
Impersonation — pretending to be another person, LactoGo staff, or a healthcare professional.
Scams and fraud — deceptive schemes, phishing, or solicitation of payments outside official Platform channels.

Report violations to team@lactogo.eu. LactoGo may, but is not obligated to, monitor community content, and is not responsible for content posted by users (see Document 7).

Document 10: Cookie Policy

This Cookie Policy explains how LactoGo uses cookies and similar technologies on lactogo.eu and the Platform, in compliance with the GDPR and the EU ePrivacy rules, and forms part of our Privacy Policy. Our site is delivered and protected in part by Cloudflare, which may set its own strictly necessary security cookies as part of that service.

10.1 What Cookies We Use

Essential cookies — required for the Platform to function (e.g., keeping you logged in, remembering security settings, Cloudflare security/load balancing). These do not require consent, as they are necessary for the service you request.
Functional cookies — remember your preferences (e.g., language, Dairy Diary display settings) to improve your experience. Used only with your consent, except where strictly necessary to a feature you have activated.
Analytics cookies — help us understand how the Platform is used in aggregate, so we can improve it. Used only with your consent.

We do not currently use third-party advertising cookies. If this changes, this Policy will be updated in advance and fresh consent will be requested.

10.2 Consent Banner and Preferences

On your first visit, you will see a cookie banner allowing you to accept all non-essential cookies, reject all non-essential cookies, or customize your choices by category. No non-essential cookie is set until you make a choice. You can change your preferences at any time via the "Cookie Preferences" link in the site footer or app settings.

10.3 Withdrawing Consent

You may withdraw consent to functional or analytics cookies at any time through the Cookie Preferences link, or by clearing cookies in your browser settings. Withdrawing consent does not affect the lawfulness of processing before withdrawal, and does not affect essential cookies required for the Platform to operate.

Document 11: Consent Text Library

Short, standalone consent statements for use at the relevant point of collection (checkboxes, sign-up forms, in-app prompts). Each is designed to be specific and separately actionable, consistent with GDPR "freely given, specific, informed, unambiguous" consent requirements.

Account sign-up: "I agree to LactoGo's Privacy Policy and Terms and Conditions."
Newsletter / marketing emails: "Send me occasional emails about LactoGo news and future features. I can unsubscribe at any time."
28-Day Challenge participation: "I understand the 28-Day Challenge is a self-directed food-awareness exploration, not a clinical trial or medical program, and that streaks, badges, and pattern insights reflect my own logged activity (see the Medical Disclaimer)."
Dairy Diary: "I choose to log meals and symptoms in my Dairy Diary to see my own patterns over time. This is optional, may be treated as sensitive data, and I can delete it at any time."
AI chat (Luna): "I understand Luna is an AI companion that provides essential information only, is not a substitute for professional medical advice, and may make mistakes (see the AI Disclaimer)."
Food scans (LactoLens): "I understand that scan results and confidence scores are for personal awareness only, may be inaccurate or incomplete, and that I must independently check product packaging before eating — especially if I have a food allergy (see the Allergy Disclaimer). Scan images are auto-deleted within 24 hours."
Analytics (non-essential cookies): "Allow LactoGo to use analytics cookies to understand how the Platform is used, so we can improve it. You can change this anytime in Cookie Preferences."

Document 12: Future-Proofing — How New Features Fit This Package

This package is deliberately drafted so that new LactoGo features can be added by (a) updating the feature list in Document 1 §1.3 and Document 2 §2.9, and (b) confirming the feature falls within an existing category below — without rewriting the core legal documents. New categories, or features that materially change the risk profile (e.g., anything that is medical, diagnostic, or handles payments for the first time), should still trigger a focused legal review before launch.

LactoGo Sachet (or other future physical/consumable products): falls outside the current LactoLens/AI-companion scope. Before launch, add product-specific terms (returns, shipping, food-safety compliance, labelling law) and confirm whether it is regulated as a food product or supplement in each target market — this is not covered by the current disclaimers and needs its own review.
LactoLens Premium / premium subscriptions / marketplace: covered structurally by Terms §2.8 (Future Subscriptions); add pricing/billing/refund terms and applicable distance-selling withdrawal rights at launch.
Mobile app, expanded food database, and personalized AI insights (currently on the roadmap): covered by the existing AI Disclaimer (Document 6) and Privacy Policy §1.6, provided personalization remains non-diagnostic.
Community Insights (aggregate, anonymous trends): covered by Privacy Policy §1.3 (analytics) and §1.6, provided the data is genuinely aggregated and anonymized before display.
Research participation: covered in principle by the consent framework in Document 11 and Document 1, but requires a dedicated research consent form (specific purpose, data use, right to withdraw) before any research program launches, and potentially ethics review depending on scope.
Apple Health, Google Health Connect, MyFitnessPal integrations, and wearables: covered by Terms §2.9 (Third-Party Services) and Privacy Policy §1.8 (transfers) as connected services; each new integration should be added by name to §1.3/§2.9 and reviewed for any new categories of health data received.
AI agents (beyond Luna): covered by Document 6, which is written to apply to "any other automated or AI-assisted feature ... now or in the future."
APIs and partner portals: covered by Terms §2.9; a separate API/partner agreement (rate limits, acceptable use, liability allocation) should be drafted before any external partner is granted API access — this package covers LactoGo's own use of third-party APIs, not third parties' use of a LactoGo API.

Rule of thumb: if a new feature is a personal-awareness tool or connects to an existing category above, update the feature lists and this package continues to apply. If a new feature is medical, diagnostic, financial/payment-related for the first time, physical-product-related, or targets a new jurisdiction, flag it for a fresh, focused legal review before launch.

Appendix: Implementation Notes

This package was built against GDPR, the Philippine DPA, EU AI Act transparency principles for limited-risk AI systems (Luna and LactoLens should carry a clear "you are interacting with AI" in-product disclosure, consistent with Document 6), EU consumer protection law (Directive 2011/83/EU, Unfair Commercial Practices Directive), and general product liability principles. The items below are operational triggers — points where a future action on your side (not a defect in the document) calls for a quick, targeted legal check rather than a full re-review:

Insert your legal entity name, registration number, and registered address wherever bracketed placeholders appear.
If your processing scales up (e.g., large volumes of Dairy Diary health-adjacent data), revisit whether a Data Protection Officer becomes mandatory under GDPR Art. 37.
